1. Acceptance of Terms
By accessing or using NationLink's member portal services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of a First Nation, band, or organization, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you may not access or use our Services.
2. Description of Services
NationLink provides a member portal platform designed for First Nations and Indigenous communities, including but not limited to:
- Member registration and profile management
- Genealogical record keeping and family tree visualization
- Document storage and management
- Community event coordination
- Administrative tools for band/nation staff
3. User Accounts
3.1 Account Creation
To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3.3 Account Types
Different account types (member, staff, administrator) have different access levels and permissions. Access is determined by your nation/band's administrators.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Upload false, misleading, or fraudulent information
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with the proper functioning of the Services
- Share your account credentials with others
- Use the Services to harass, abuse, or harm others
- Violate the intellectual property rights of others
5. Content and Data
5.1 Your Content
You retain ownership of any content you upload to the Services. By uploading content, you grant NationLink a limited license to store, process, and display that content as necessary to provide the Services.
5.2 Community Data
Data uploaded by or on behalf of a nation/band belongs to that community. See our Data Sovereignty policy for more information about community data rights.
6. Fees and Payment
Our Services are provided on a per-member pricing model. Current pricing is available on our website. We reserve the right to change pricing with 30 days' notice. All fees are non-refundable unless otherwise specified.
7. Service Availability
We strive to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. We are not liable for any interruptions beyond our reasonable control.
8. Termination
Either party may terminate the service agreement with 30 days' written notice. Upon termination:
- You may request an export of your data within 30 days
- Access to the Services will be revoked
- Data will be deleted within 90 days of termination (unless legally required to retain)
9. Limitation of Liability
To the maximum extent permitted by law, NationLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
10. Indemnification
You agree to indemnify and hold harmless NationLink and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of British Columbia.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes at least 30 days before they take effect. Continued use of the Services after changes become effective constitutes acceptance of the modified Terms.
